Repossession Facts?

You have the right not to be repossessed. If you are threatened with repossession, call us immediately on 08700 42 52 64. Our advisers can negotiate with your lender and avoid the time and expense of going to court. It's usually possible to prevent arrears from becoming a major issue that leads to repossession.

The below facts will help you to understand how we can postpone or halt the repossession process:

The majority of lenders will only repossess your home as a last resort. They usually prefer to sort out arrears problems in other ways based upon:

  • how far behind you are with payments
  • what type of mortgage you have
  • the reasons for your arrears (e.g. redundancy)

Don't ignore your lenders letters or phone calls. Call EVICT STOP on 08700 42 52 64 to obtain advice. An adviser may be able to help you come up with a strategy to manage your arrears and keep your property.

Lender Letters

The initial correspondence is a letter reminding you that you have missed one or two payments. It will normally ask you to:

  • state how you intend to catch up on arrears, or
  • contact your lender to discuss your mortgage situation

If your lender isn't satisfied with your proposals, or your arrears increase, it will probably write to you again. The second letter states that solicitors will be actioned if you don't clear your arrears or contact your lender to discuss the situation within seven days. EVICT STOP will communicate with your lender, ensuring that the matter is managed professionally.

Lender's Solicitor

Your lender's solicitors will send you a letter giving you seven days to pay off all your arrears or make a proposal for doing so. If they are not satisfied with your response, they can immediately start court action.

EVICT STOP can negotiate for you at this stage. Even if you can't come to an agreement, the court is more likely to be sympathetic if you made an effort to sort things out before legal action was started. Our advisers can help you to do this. Call us immediately on 08700 42 52 64.

DO NOT STRUGGLE BY YOURSELF. AS SOON AS YOU RECIEVE ANY CORRESPONDANCE FROM YOUR LENDER CALL.
